Affiliate Program Terms of Service

Introduction

Welcome to the Freedom Tech Solutions Affiliate Program (“Program”). This Program allows you, the “Affiliate,” to earn commissions by promoting and selling Freedom Tech Solutions’ products through your unique affiliate links. By participating in the Program, you agree to abide by these Terms of Service (the “Agreement”).

Definitions

• “You” and “Affiliate”: Refers to the individual or entity, other than Freedom Tech Solutions, entering into this Agreement and participating in the Affiliate Program.
• “Affiliate Program”: Refers to our affiliate program as described in this Agreement.
• “Affiliate Lead”: A potential customer who clicks on an Affiliate Link provided through the Affiliate Dashboard.
• “Affiliate Link”: A unique tracking link assigned to you, which you promote through your website and other channels.
• “Affiliate Dashboard”: The software platform accessible through [Freedom Tech Solutions Affiliate Dashboard URL] that tracks your affiliate activities.
• “Commission”: The monetary value calculated based on eligible products sold, multiplied by your Commission Tier, as shown in the Affiliate Dashboard.
• “Commission Tier”: The category grouping of an Affiliate based on size or performance, which directly impacts the commission rate.
• “Tier Schedule”: A performance outline provided by us that can influence your Commission Tier.
• “Eligible Product”: A product that qualifies for earning commissions.
• “Transactions”: Purchases made by Affiliate Leads that qualify as Eligible Products.
• “Payments”: Commissions paid by us to you.

Enrollment

To start the enrollment process, you must submit a complete application via our website. We will review your application and notify you of acceptance or rejection. We reserve the right to reject any application at our discretion, for any reason.

Affiliate Responsibilities

1. Account Information: You agree to provide accurate and up-to-date information about yourself. You must promptly update all information to keep your affiliate account current, especially changes in email addresses, bank details, etc. Commissions may be withheld if your information is outdated or inaccurate.
2. Legal Compliance: You must operate in compliance with all applicable laws, rules, and regulations.
3. Marketing Practices: You agree to use ethical and legally compliant practices in your promotional activities. Use of spam or illegal tactics is strictly prohibited.

Removal of Affiliates

We reserve the right to terminate your participation in the Program at any time, with or without cause, by providing written notice. Causes for removal may include breaches of this Agreement, illegal or unethical marketing practices, or activities that may damage the reputation of Freedom Tech Solutions.

Payments

1. Commission Tiers: Each affiliate accepted into the program is assigned a commission tier. You can advance your tier by meeting sales performance goals outlined in the Tier Schedule. Commission tiers can change due to inactivity, weak sales performance, or other factors. These metrics are reviewed quarterly. We reserve the right to adjust commission tiers, performance goals, and the Tier Schedule at any time. Changes to commission tiers only apply to future sales.
2. Commission Payments: Commissions are calculated in USD. Payments for sales in a calendar month are typically processed within six weeks after the end of that month, but we do not guarantee a specific payment date.
3. Payment Errors: If an excess payment is made to you, we reserve the right to adjust or offset this amount against future payments.

Acceptance of Commissions

Commissions are generated only for transactions involving Eligible Products promoted through your Affiliate Link. Our Program uses cookies to track referrals, with a 180-day expiration. If a user completes a purchase after the cookie expires, you will not earn a commission for that sale.

Intellectual Property

You are granted a non-exclusive, non-transferable, revocable right to use our marketing materials and affiliate links solely for promoting Freedom Tech Solutions. Modification of any branding or marketing materials without our prior written consent is prohibited.

Disclaimer of Warranty

Freedom Tech Solutions provides the Affiliate Program and related services “as is,” with all faults. We make no representations or warranties, whether expressed or implied, regarding the Affiliate Program or any associated software or content.

Limitation of Liability

We will not be liable for indirect, special, or consequential damages, including loss of revenue, profits, or data arising in connection with this Agreement or the Program, even if advised of the possibility of such damages. Our aggregate liability will not exceed the total commissions paid or payable to you under this Agreement.

Miscellaneous

1. Independent Contractors: The relationship between Freedom Tech Solutions and you is that of independent contractors. Nothing in this Agreement creates a partnership, joint venture, agency, franchise, sales representative, or employment relationship.
2. Governing Law: This Agreement shall be governed by and interpreted in accordance with the laws of the United States, without regard to conflicts of laws principles.
3. Amendment: We may amend this Agreement at any time by posting the amended terms on our website. Such amendments are effective upon posting.

By participating in the Freedom Tech Solutions Affiliate Program, you acknowledge that you have read this Agreement and agree to all its terms and conditions. You have independently evaluated the desirability of participating in the program and are not relying on any representation, guarantee, or statement other than as set forth in this Agreement.
