Acceptable Use Policy

This Acceptable Use Policy (“AUP”) outlines the acceptable use of FreedomTechSolutions Services by the Customer and Customer’s customers (as applicable). All capitalized terms not defined herein shall have the meaning set forth in the Agreement, which is hereby incorporated by reference.

Compliance with Laws

FreedomTechSolutions Services may not be used as follows:

1. To send unsolicited bulk and/or commercial messages in violation of the Spam Act 2003.
2. To infringe upon the intellectual property rights of a third party or in violation of the Copyright Act 1968.
3. To conduct activities in violation of any Australian law.
4. To traffic or promote illegal substances, gambling, or any products or services that are prohibited under applicable law.
5. To gain unauthorized access to the computer networks of any other party in violation of the Cybercrime Act 2001.

Harmful Activities

FreedomTechSolutions Services may not be used as follows:

1. To distribute pornography or obscene materials.
2. To threaten persons with harm or violence.
3. To harass, abuse, or defame others.
4. To solicit the performance of illegal acts or services.
5. To support or promote illegal activities.
6. To deceive or mislead through fraudulent or misleading websites.
7. To provide access to unauthorized individuals through sharing of passwords or access codes.

Abuse and Misuse of Services

FreedomTechSolutions Services may not be used as follows:

1. For disruptive, abusive, or harmful activities.
2. For brute force attacks or other types of invasive procedures.
3. To participate in file sharing or peer-to-peer activities without proper authorization.
4. To cause denial of service attacks against FreedomTechSolutions or other networks, or to disrupt or degrade the operation of FreedomTechSolutions’s systems or networks.
5. To distribute harmful software such as viruses, worms, Trojan horses, or malicious code.
6. To subvert, or assist in subverting, the security or integrity of FreedomTechSolutions’s systems or networks.

Prohibited Use of Services

FreedomTechSolutions Services may not be used in any manner that:

1. Subjects FreedomTechSolutions to unfavorable regulatory action or liability.
2. Adversely affects FreedomTechSolutions’s public image, reputation, or goodwill.
3. Involves sexually explicit, hateful, vulgar, racially, ethnically, or otherwise objectionable materials as determined by FreedomTechSolutions in its sole discretion.

High-Risk Use Prohibited

Services shall not be used in connection with any activities that may lead to death, serious bodily injury, environmental damage, or substantial damage to personal or real property.

Disclaimer

FreedomTechSolutions expressly disclaims any obligation to monitor its Customers and their customers for violations of this AUP. FreedomTechSolutions has no liability for the actions of its Customers or any content posted by Customers or their customers on any website.

Remedies

If FreedomTechSolutions learns of a violation of this AUP, FreedomTechSolutions will respond to the applicable Customer and may, in FreedomTechSolutions’s sole discretion, take any of the following actions, in accordance with the severity and duration of the violation:

1. Suspend the offending Customer from the Services;
2. Terminate the offending Customer’s use of the Services;
3. Remove the violating content; and/or
4. Take other action to protect FreedomTechSolutions’s interests.

Reservation of Rights

FreedomTechSolutions reserves the right to cooperate with investigations of claims of harmful activity involving its Services. FreedomTechSolutions reserves all rights to respond to violations of this AUP. FreedomTechSolutions may monitor communications through its network to prevent the introduction of harmful code, prevent intrusions, and enforce this AUP.
